  • Served as sole Texas counsel to large national bank and their borrower/restaurant operator, in the acquisition of two commercial parcels valued at over $3 million and located in Houston, Texas for the purposes of development of two company restaurant chains.
  • First chair jury trial attorney defending homeowner of multi-million dollar property in upscale subdivision of Austin, Texas. Served as lead counsel on case related to statutory violations of the Texas Property Code, fraud, conspiracy, and aiding and abetting from inception and filing of suit through trial and final jury verdict. Post trial, successfully defeated plaintiffs’ motion for judgment notwithstanding verdict.
  • Served as lead counsel representing 14 defendants in declaratory judgment suit related to existing deed restrictions covering residential community in upscale neighborhood in Houston, Texas.
  • Representation of seller of multi-million dollar retail strip center on sale of property to real estate developer purchaser. Included drafting of contract documentation, review of title commitments, surveys, and environmental reports. Negotiation with buyer’s counsel and direct interface with title company related to all closing issues including closing documents, settlement statements, estoppel certificates, execution of instruments for closing and funding.
  • Represented commercial real estate client in acquisition of commercial property for the purposes of future retail or light commercial development as a single user, pad or strip center. Handled sales contract negotiations with Coldwell Banker Real Estate, review of title commitment, and restrictions imposed by former owner, Wal-Mart Development, Inc.
  • Commercial Lease negotiations on retail strip center development in El Paso, Texas with approximate value of $6 million.
  • Represented multiple new homeowners in Williamson County who contracted with local central Texas builder for the construction of their homestead and who had suffered in excess of 10 mechanic’s and materialman’s liens per home filed against their homestead. Successful in examining, challenging and obtaining removal of 90% of all liens filed.
  • Represented a physician in a residential construction defect claim on a property valued at approximately $450,000.00.
  • Represented plaintiff against residential builder in Travis County in litigation under the Texas Deceptive Trade Practices Act for nondisclosure of property defects and failure to timely cure such defects. Included completion of SIRP process for construction defect inspection, filing of suit under the Texas DTPA and fraud in a real estate transaction. Completion of discovery, designation of experts for trial and completion of appraisal analysis used as a determinative for value to assess damages deemed in excess of $100,000.00. Successfully negotiated favorable final settlement for client.
  • Representation of client in litigation under the Texas Deceptive Trade Practices Act for nondisclosure of property defects including mold found in plaintiff’s property post purchase.
  • Represented real estate owner/developer in subdivision whereby developer carried second-lien notes for purchasers. Upon default of purchaser under the second-lien notes, instituted notice proceeding and default judgment proceedings. Successfully won default judgment for client.
  • Represented client in residential construction defect claim related to builder’s negligence in repair of flooring in residence valued at $460,000.00
  • Representation of client owning 10 acres of residential land as part of a section of land in Lubbock, Texas. Legal representation included the modification of existing deed restrictions covering the entire section of land.
  • Representation of client in preparation and execution of warranty deeds for the purposes of deeding 4 parcels of property totaling over $1 million in value from client, as Trustee for the benefit of two separate family trusts.
  • Complete representation of client in default on payment of residential mortgage. Requirement of proving up payments made beginning 1987-2005, proof of payment of taxes, proof of payments in default and negotiation of settlement with noteholder. Successfully negotiated on behalf of client in order to avoid foreclosure proceedings.
  • Ongoing representation of mortgage brokers and private individuals related to private financing on real property transactions. Review of title commitments, curing of title defects, advising and drafting of closing documents, including notes, deeds of trust, and assignments. Review of HUD-1 Settlement Statements and instructions to title company on behalf of client.
